Terms & Conditions - Loyalty Program
The So Susan Loyalty Program (the “Program”) is a loyalty reward program offered by So Susan Ltd (the “Company”, “us”, “our” or “we”) to certain customers of the Company. The Program is accessible through www.sosusan.com (the “Program Website”) and any other related sites and applications referred to on the Program Website including without limitation, https://www.sosusan.com/pages/loyalty-program and https://colorcurate.sosusan.com/pages/loyalty-points-faq (the “Explainer Pages”). The Program allows persons who have completed the membership enrollment steps (each, a “Program Member” or “Member”) in accordance with the present Terms and Conditions to collect points when making purchases on items identified from time to time by the Company (“Eligible Purchases”), and to redeem these points for rewards, benefits and/or rebates offered by the Company from time to time. Members acquire no vested right or entitlement to the continued availability of any particular reward, benefit or redemption level.
Products within our store available to be obtained in exchange for Loyalty Points may vary, as the Company cannot accommodate specific Customer requests for certain products. Products are available only while supplies last and their quantities may be limited. You will not be able to redeem Loyalty Points for purchases unless the Customer has sufficient points for that purchase.
REFUNDS & RETURNS
Any products bought as a result of redemption of Loyalty Points may not be exchanged, refunded or returned. Purchases made with Loyalty Points will ship in the normal course of business.
LOYALTY POINTS FORFEITURE
All points will be forfeited once your Color Curate subscription is cancelled. You cannot use your Loyalty Points and forfeit any points you may have had when your subscription(s) lapsed or was discontinued / cancelled.
CHANGES TO THE LOYALTY PROGRAM
The Company reserves its rights to change or modify the terms of the Loyalty Program, including the amount of Loyalty Points provided for any Customer action, the time when accumulated points are applied to a Customer’s account, the items available to be obtained in exchange for points, the amount of points necessary to obtain a product, and every other term, condition and aspect of the Loyalty Program at its sole discretion at any time without notice, so it is important to check the Loyalty FAQ & Terms and Conditions periodically. Your continued use of the Loyalty Program after the date that any such changes become effective constitutes your acceptance of the new terms.
The Company may, in its sole and absolute discretion, cancel, change, suspend or modify any aspect of the Loyalty Program, including the availability of any Program Reward, and/or any Program Reward at any time, without notice. If we terminate the Program, all Loyalty Points will be cancelled with immediate effect.
LOYALTY PROGRAM CUSTOMER CONDUCT STANDARDS
LOYALTY POINTS REDEMPTION CONDITIONS
Loyalty Points Redemptions may be taxable, depending on the value of the item and the federal, state, and local tax laws applicable to the Customer. You are solely responsible for reporting such items on their tax returns and paying any associated tax liability. You may not assign or transfer any Loyalty Points. The Company makes no warranty in any respect as to any Loyalty Points, redeemed items, merchandise or service available within the Program.
This Program will continue until terminated, suspended, modified, or converted to another rewards program by the Company (the "Program Period"). If we terminate the Loyalty Program, all Loyalty Points will be cancelled with immediate effect. The Company reserves the right to adjudicate all Loyalty Points discrepancies in its sole discretion and the Customer agrees to abide with any such determination made by the Company.
By participating in the Program, you release the Company, its subsidiaries, affiliates, suppliers, advertising and promotions agencies and their respective directors, officers, employees, and agents (collectively, "Released Parties") from any and all liability for any loss, harm, damages, cost or expense, including, without limitation, property damages, personal injury and/or death, arising out of or in any way connected to the Program and/or the use of any redeemed items.
You agree to indemnify, defend and hold the Company and its representatives and agents harmless from and against any and all third party claims, demands, liabilities, costs or expenses, including attorney's fees and costs, arising from, or related to any breach by yourself of any of these Loyalty Program Terms and Conditions or any violation by yourself of applicable law.
The laws of the United Kingdom shall govern these Loyalty Program Terms and Conditions. The Customer hereby expressly consents to exclusive jurisdiction and venue in the courts located in the UK for all matters arising in connection with these Loyalty Program Terms and Conditions or Customer's participation in the Program.
